General Statutes Chapter One Definition, Composition and Purpose Article 1 The Pan American Basketball Confederation is constituted as “FIBA Continent Zone for America” from now on FIBA Americas, taking into consideration what is established in Articles 44 to 47 of the General By-Laws of the International Basketball Federation, FIBA. Article 2 FIBA Americas should be organized in an adequate way, as determined by legal order from the headquarters country. Article 3 FIBA Americas, is a non-for-profit organization and as principle does not seek any economical objective for its own benefit. Article 4 FIBA Americas, is constituted by the National Basketball Federations and Associations of America, affiliated to FIBA. Article 5 With the objective of better coordination of Basketball in the Continent, the following Zone Commissions are established in the FIBA Americas Congress: a) Central America and the Caribbean b) North America c) South America For FIBA Americas, the Zone Commissions promote, supervise and direct Basketball within their corresponding regions in strict compliance with the policies established by the Congress, the Central Board and the Executive Committee. The Zone Commissions are not authorized to represent FIBA Americas, unless they do it at the request of the General Secretary. Each Zone Commission must be organized in a way that the best conditions prevail in its territory. A National Federation may belong to one Zone only. The Zones must have their own Statutes and Regulations, which must agree completely with the Statutes and Regulations of FIBA and FIBA Americas. These documents must be presented to the Directive Board of FIBA Americas for their approval. Article 6 FIBA Americas, will look for the integration of Basketball of the Americas in collaboration with the existing Zone Commissions in America and according to that specified in the General Statutes and Internal Regulations of FIBA. Article 7 The General Statutes and Internal Regulations of FIBA Americas must agree with those of FIBA, which will ratify them. Article 8 The headquarters of FIBA Americas, shall be established in San Juan, Puerto Rico. Any change to these headquarters to another city must be approved by the Congress of FIBA Americas. Article 9 FIBA Americas, shall maintain absolute political and religious neutrality and will not allow any discrimination racial or otherwise. Article 10 FIBA Americas, coordinates Basketball activities within the Americas, especially: a) Spread and obey the current Game Rules throughout. b) Prepare the Annual Activity Calendar. c) Technically control and direct the Basketball competitions, for women and men between National Team and Club that at a continental level are organized and where countries or teams of more than one Zone participate. d) Organize and control, in coordination with FIBA, the “Masculine and Feminine Tournaments of Olympic Classification in America”, determining the financial system and the competition system. f) Organize and control, in coordination with FIBA, the Tournaments of the Americas that will classify for the following events: 1. The World Championship for Men 2. The World Championship for Women 3. The World Championship for Junior Men 4. The World Championship for Junior Women 5. The World Championship for Young Men 6. The World Championship for Young Women f) FIBA Americas determines the financial system and the competition system of each one of the Tournaments of the Americas. g) Govern and controls the appointment of international referees in Tournaments, Championships and Competitions under its jurisdiction. g) Organizes and controls in coordination with FIBA all the competitions in America, including the Three by Three, Beach Basketball and others. Second Chapter Organs of FIBA Americas Article 11 The Organs of FIBA Americas are: a) The Congress b) The Central Board c) The Executive Committee d) The General Secretary of FIBA Americas e) The Permanent Commissions: I. Technical Commission II. International Competitions Commission III. Legal Matters, Statutes and Regulations Commission IV. Eligibility Commission V. Finances and Budget Commission VI. Youth Basketball Commission VII. Basketball Academy Commission VIII. Womens Basketball Commission f) The Special Commissions: IX. Appeals’ Commission X. Television and Marketing Commission XI. Basketball for Persons with a Disability Commission XII. Medical Commission XIII. Mini-Basketball Commission XIV. Media Commission g) Organizations officially recognized by FIBA Americas. Article 12 The Congress and the Central Board may designate other Commissions. The Commissions designated by the Central Board will be temporary until a decision from the Congress assigns them a permanent condition or until their work is done. The Secretary General and the Deputy Secretary General integrate all Commissions of FIBA Americas. FIRST DIVISION THE CONGRESS Article 13 The Congress is the maximum organs of FIBA Americas and possesses all powers, according to the dispositions from the following General Statutes and their Internal Regulations. The Congress is made up of: a) Two Delegates maximum per National Federation Member, with full rights, but with the right to only one vote for the Main Delegate, if both are present. b) The Members of the Central Board of FIBA Americas, who will only have voice to consult, unless they officially represent a Member entity. c) The President and the Members of FIBA Americas in the Central Board of FIBA, who only have voice to consult. The participation credentials of the Delegates, Members of the Central Board of FIBA Americas and Members of the FIBA Central Board, must be handed in to the Secretary General 24 hours before the opening of the General Assembly. So that the Delegates can participate in the Congress, its Federations must be on time with their payments to FIBA, FIBA Americas and its corresponding Zone. Article 14 The Congress meets in Ordinary Session each four (4) years on a date close to the World Championship for Men dispute, therefore 2002, 2006, 2010, etc. However, the Congress’ date, time and agenda will be set by the Secretary General, consulting with the President. The Federations Members will be informed about the Congress through certified mail at least 60 days before its date. Article 15 If at least half plus one of the Federations Members that are on time with their dues to FIBA, FIBA Americas and their Zone or as proposed by the Central Board, the Congress may be called to an Extraordinary session of Congress. The Federations Members must be notified the date, place and agenda through certified mail at least 90 days before its date. Article 16 The President of FIBA Americas presides the Congress. He votes only in case votes are tied. If for some reason the President cannot preside the Congress, the Vice President will replace him. Article 17 When a National Federation is organizing Congress, it will be in charge of the expenses of stay for the members of the Central Board, travel and stay of the President, the Secretary General and the Deputy Secretary General of FIBA Americas and the administrative expenses of the meeting. Article 18 Attributions of the Congress: a) Adoption, approval and modification of the General Statutes, as well as the ratification of the Regulations and of the Permanent Commissions that are put to consideration by the Central Board. b) Receive and comment about the reports that the Central Board presents. c) Approve what is necessary for the benefit, diffusion and progress of Basketball in America and the world. d) Hand in to the Central Board the agreements need its intervention. e) Study the budget present it to the Central Board and eventually approve it. f) Propose the names of the people that because they have serviced America’s Basketball, may be designated Honorary Members of FIBA Americas and FIBA. Article 19 Modifications and/or reforms of General Statutes: a) In the agenda for the Congress’ session, only the issues proposed by the President of FIBA Americas, the Secretary General, the Central Board or the affiliated National Federations will be noted, as long as these matters are included in the attributions of Congress. The proposals must be presented to the Secretary General at least 90 days before the date of the Congress. The final agenda will be established by the Secretary General and must be included in the invitation letter to Congress. b) Proposals must be made known to the members of the Central Board and the National Federations at a minimum of 45 days before the date that the Secretary General designates for the meeting of the Congress. c) According to the study and approvals made by the Central Board about the subjects to discuss, the Secretary General will designate a final agenda will include the invitation letter to the Congress. d) In case of an extraordinary session of Congress, the issues to be noted will be determined in the application to said session. However, only those matters included in Congress’ attributions will be included in the agenda. Article 20 Congress’ decisions will be made with fifty percent (50%) plus one of the votes from the Delegates present (see Article 13). These decisions are final and not subject to appeals. SECOND DIVISION THE CENTRAL BOARD AND THE EXECUTIVE COMMITTEE I. The Central Board Article 21 The Central Board will be the Executive Authority of FIBA Americas, with the powers delegated to it in these Statutes and Internal Regulations. Article 22 The Members of the Central Board will last at their posts four (4) years, and may be reelected. In case of the resignation or death of one of its members during the period between two Congresses, the Central Board will name his/her replacement taking into consideration the Zone to which the person belonged. Article 23 The Central Board is made up of the following members with a right to vote: a) President FIBA Americas b) Vice-President FIBA Americas c) Secretary General FIBA Americas d) Treasurer FIBA Americas e) Four members for North America: e.1 Two members designated by USA Basketball e.2 Two members designated by Canada Basketball. f) The Presidents of the Zone Commissions who do not occupy the Vice President of the period, designated by their corresponding Congresses. g) Four members for each of the Zones, South American, Central American and the Caribbean, designated by the presidents of the corresponding zones and ratified by their corresponding Congresses. h) The Members of FIBA Americas, which are part of the Central Board of FIBA. i) The Presidents of the Commissions: Technical; International Competitions, Legal Matters, Statutes and Regulations, Eligibility; Finances and Budget; Youth Basketball, Basketball Academy; Women Basketball. Article 24 The following are also members of the Central Board, but do not have a right to vote: a) The Deputy Secretary General and the Secretaries Adjunct. b) The Ex-Presidents of FIBA Americas, after the expiration of their terms as Presidents. c) In each period of 4 years the Members of America who were part of the Central Board of FIBA in the previous term. Article 25 The Central Board will meet at least once a year in the corresponding four year term. Article 26 The Presidency of FIBA Americas will rotate corresponding to the first 4 years (1975-1979), to the Central America and Caribbean Zone Commission representative and followed by the representative that the South America, North America, and so on, Zone Commission designates. The Vice Presidency will correspond to that member of the Zone Commission that in the next period will be elected as President. Article 27 In the first meeting after its creation, the Central Board will name the Secretary General and the Treasurer for FIBA Americas. Article 28 The National Federation organizing a meeting of the Central Board, must inform the Secretary’s office forty-five (45) days before the date of the meeting, the name of the hotel, address, telephone number and fax number where the members will be staying. Also, the place where the meetings will take place, making sure that it has the facilities needed for simultaneous interpreting. Article 29 The National Federation organizing a meeting of the Central Board will be in charge of the expenses of lodging for its members and all the meeting’s expenses. Article 30 The agreements made in the meetings of the Central Board will be considered fifty percent (50%) plus one vote by its present members (See Article 23). In case of a tie, the President decides. Article 31 The Central Board will have the following main tasks: a) Name the Secretary General and Treasurer b) Name the President, Vice President, and the Members of the Permanent and Special Commissions of FIBA Americas c) Represent FIBA Americas, through its President or its Secretary General, according to that established by its Statutes and Regulations. d) To study proposals, suggestions and reports that are sent by the Zone Commissions, Permanent Commissions, Special Commissions and Members of National Federations. e) To approve the budget and income and expenses as reported by the Executive Committee. The budget must be presented to the Congress for its approval. f) To present to the Congress a report of its activity and the finished balance. g) To carry out all the tasks through its members. h) To prepare, in coordination with the Zone Commissions, the Calendar of Activities. i) To sponsor and support the Tournaments, Competitions and games among National Teams and Clubs, Senior and Junior (Masculine and Feminine), Young Men and Women and Mini Basketball. j) To coordinate the organization of Clinics for Coaches, Referees, technical personnel in general and all other training activities that it deems necessary. k) To present to the Central Bureau of FIBA, the proposals for changes to the Statutes, Internal Regulations and Official Rules of FIBA. l) Ratify the National Instructors designated by the National Federations, according to the rules suggested by the Basketball Academy of America. m) To establish and modify the Internal Regulations. n) To name the members of FIBA Americas who join the Central Bureau of FIBA (Art. 18 inc. d – FIBA Statutes). o) To name the Vice-President of FIBA (Art. 18, inc. e – FIBA Statutes) by FIBA Americas, according to the order North Zone: 2002 - 2006 South Zone: 2006 - 2010 Central Zone: 2010 - 2014 so on, in rotations II. The Executive Committee Article 32 a) The Executive Committee is an organ composed of the President, the Vice President, the General Secretary, the Treasurer and the President of the Zones do not occupy the Vice Presidency and the Deputy Secretary General. b) The Executive Committee will work according to that delegated by the Central Board (except art. 12, 27 and 31, inc. a), n) and o) of the FIBA Americas Statutes) and urgent matters and its decisions will be ratify in the first meeting of the Central Board. c) The Executive Committee will meet each time that the Secretary General calls it, in coordination with the President or by half plus one of its members 3 times a year minimum. d) The agreements of the Executive Committee will be considered with half plus one of the votes of its present members. In case of tie, the President decides. The Deputy Secretary General has no right to vote in the Executive Committee. THIRD DIVISION THE SECRETARY GENERAL AND TREASURER Article 33 The Secretary’ office is composed of the Secretary General, the Deputy Secretary General and the Treasurer. These are helped in the Permanent Office by the Secretary personnel under the direction of the General Secretary, the General Sub Secretary and the President. Article 34 The Secretary General works until the cycle term determined by his/her contract. Article 35 The Secretary General has the following tasks: a) To carry out all the decisions made by Congress, the Central Board or the Executive Committee. For this, he/she must have the authority to name the special personnel necessary for the correct functioning of the office in the administrative and technical aspects. b) To organize and control all the International Competitions under the control of FIBA Americas (See Article 10). c) To assure that the Statutes and Regulations of FIBA Americas are being carried out. d) To call and prepare Congress, in coordination with the President. e) To maintain the archives. f) To publish and send the Statutes and Internal Regulations of FIBA Americas to the Members of the Central Board, the members of the FIBA Americas Commissions and the members of the National Federations; to publish and spread all the activities through the media which he/she deems convenient. g) To publish and send the current Official Game Rules in Spanish to the members of the Central Board, the members of the Commissions of FIBA Americas and to the members of the National Federations. h) To write and distribute the official news. i) To hand out and transmit all ordinary matters. j) To elaborate, in coordination with the Finances and Budget Commission, the Budget Project to submit for study to the Executive Committee. Article 36 The Secretary General can designate, with the approval of the Central Board to the Deputy Secretary General and one or more of the Adjunct Secretaries. The Deputy Secretary General will carry out the tasks designated by the Secretary General and in case of the latter’s impediment, temporary or definitive, he/she will replace him/her until the next session of the Central Board. Article 37 The Treasurer, directly and in close collaboration with the Secretary General, has all the following tasks: a) The control, in all ways, of the financial administration of FIBA Americas. b) The verification of the countable documents and the approval of periodical financial reports. c) To assure the incomes of the annual appraisals of the members, as well as all the contributions, rentals, fees and fines imposed by the competitive organisms of FIBA Americas, in coordination with the Secretary General. d) Keep track of accounts of income and expenses, which he/she will submit to the President for his/her control. FOURTH DIVISION THE PERMANENT AND SPECIAL COMMISSIONS Article 38 The Permanent and Special Commissions of FIBA Americas (Article 11 e) and f)) are composed of a President, a Vice President and five (5) Members designated by the Central Board for a period of four (4) years. Each Permanent and Special Commission is integrated by members who representing the Zones of America, are part of the corresponding Commissions of FIBA, plus those additional that the Central Board may name, as proposed by the Secretary General. When it is deemed necessary, the number of members for the different Commissions may vary. The Central Board will designated the President and Vice President of each Permanent and Special Commission of FIBA Americas. Article 39 The Permanent or Special Commissions meet, at least once every four (4) years at the same time that the meets and work through correspondence. Each time that it is necessary and possible, the President of a Commission may call, along with the Secretary General, a special and restricted meeting, communicating the matters discussed immediately to the absent members. Article 40 The Permanent and Special Commissions do not have executive tasks. However, their members can be designated by the Secretary General to perform executive tasks, and in these cases they will not act as representatives of their Commission, but as representatives of the Secretary General. The Members of the Commissions that do not participate actively in the tasks of their Commission can be replaced as per decision of the Central Board. Article 41 The Central Board can submit for approval of the Congress, the creation of specialized committees or other structures subject to the rights and obligations determined by the corresponding section of the Internal Regulations. I. THE TECHNICAL COMMISSION Article 42 The Technical Commission translates to Spanish the Game Rules, unifies the criteria of their application according to the Technical Commission of FIBA also prepares suggestions to modify them and is competitive to decide in dubious and unforeseen cases. The suggestions for modifications to the Game Rules must be communicated to the Secretary General of FIBA Americas. The Secretary General of FIBA Americas will present the suggestions proposed to the Secretary General of FIBA. Article 43 The Technical Commission is also responsible for the training, tests and qualification of the International Referees as well as to prepare them for the large International Competitions, the Men Basketball as well as the Women Basketball. In addition, it will be its responsibility to assess all matters concerning the practical application of the Official Basketball Game Rules. II. THE INTERNATIONAL COMPETITIONS COMMISSION Article 44 The International Competitions Commission is responsible to study and write the Regulations and Calendars of all the International Competitions as well as the approval of the dispute systems and rules of the different events established in FIBA Americas that are related to the International Competitions. III. LEGAL MATTERS, STATUTES AND REGULATIONS COMMISSION Article 45 The Legal Matters, Statutes and Regulations Commission will be responsible for all subjects concerning the different situations related to legal matters in the interpretation of the practice of our sport in our continent. This Commission, shares the responsibility of writing the official text of the Statutes and Internal Regulations of FIBA Americas with the Secretary’s office. As per request of the President and Secretary General, analyzes the modification projects that have been presented and reports them to the Central Board. Also reports whenever it is deemed necessary, its own suggestions for modification or interpretation of the Statutes and Internal Regulations to the Central Board. IV. ELIGIBILITY COMMISSION Article 46 This Eligibility Commission will have the specific job to assess the subjects concerning the eligibility of players for their participation in the National teams. Also, it will study all the cases in which its participation is required, for the analysis and verification of the documents related with the Nationality of Players and their possibility representing a country. It will be in charge of producing the documents for other cases viewed in the Internal Regulations of FIBA and will recommend their application or modification to the central Board. The President of the Legal Matters, Statutes and Regulations Commission or another member of the Commission may attend the Meetings as consultant. V. FINANCES AND BUDGET COMMISSION Article 47 The Finances and Budget Commission will have the following tasks: a) To prepare a budget of possible income and expenses for annual periods and every four (4) years (2003, 2006, etc.). b) To present the reports on financial aspects as deemed necessary to the Central Board. VI. YOUTH BASKETBALL COMMISSION Article 48 This Youth Basketball Commission’s primary responsibility is the permanent attention to activities related with the formation and development of our athletes in their basic stages. It must study and give the necessary recommendations on training formats and calendars of competitions adequate for the youth basketball players. This Commission may be divided in work groups to work with boys and girls separately and also invite to their meetings, experts in the area of attention to young players. The competition of the Commission starts from the moment in which the players start their activity in Mini Basketball and ends due to age, when they are no longer eligible to play Basketball in the younger categories established by the Internal Regulations of FIBA. VII. BASKETBALL ACADEMY COMMISSION Article 49 The tasks of this Commission are directly related to the organization, jobs and resources of the Basketball Academy of America. It must study and propose each and every one of the activities that the Academy must develop for the correct promotion of our sport and the adequate training of each and everyone involved in the game, directly and indirectly. VIII. WOMEN BASKETBALL COMMISSION Article 50 The Women Basketball Commission is responsible to study the particular problems of Women Basketball of FIBA Americas. It must study and propose the measures necessary for the development and promotion of Women Basketball as well as everything concerning the systems and calendars of the International Competitions to the Central Board. IX. APPEALS COMMISSION Article 51 The Appeals Commission will have as main duties to receive the records, listen and decide about all aspects related to sanctions imposed by FIBA Americas or disciplinary bodies, except in those cases which, specified in the Statutes or Regulations, their intervention is not possible. All this according to the corresponding articles of the Regulations, Statutes and Internal Regulations of FIBA. X. TELEVISION AND MARKETING COMMISSION Article 52 The Television and Marketing Commission will be responsible to study all the matters concerning promotion, commercial and sale in all aspects related to technical activities and tournaments in our continent. It will also be responsible to study the media to assure the financial resources of FIBA Americas and to prepare a report about these studies so that it can be submitted to the Central Board. XI. BASKETBALL FOR PERSONS WITH DISABILITY COMMISSION Article 53 The main task of the Basketball for persons with Disability Commission is to develop Basketball for disability persons in the countries members of FIBA Americas. The Commission must keep a close relationship with the corresponding Commission in FIBA and collaborate with the International Organizations of Special Sports. Particularly, the Commission must provide its help in the organization of International Competitions and in the organization of Training Clinics for Referees and Coaches. XII. MEDICAL COMMISSION Article 54 The Medical Commission of FIBA Americas is an Organs exclusively as consultant. Its duty is to inform and report everything concerning strictly medical cases and assists the Secretary General of FIBA Americas in these aspects. It must also establish rules for matters related to the control of forbidden substances and report them to the Central Board for their consideration. During all the official competitions of FIBA Americas, a meeting of the doctors of the different National teams participating must be organized. A report must be presented to the Secretary General. The Medical Commission of FIBA Americas, will be as competitive as its equal in FIBA, according to the Articles 38 and 39 of its Statutes. XIII. MINI BASKETBALL COMMISSION Article 55 This Commission will assess all matters specifically of the category according to that established by the corresponding Youth Basketball Commission. The President of this Commission must be a part of the Youth Basketball Commission. It will prepare annually a program of the International activities to be had and will present them to the Secretary General for their final approval. It must maintain permanent communication with the corresponding Commissions of the National Federations. XIV. MEDIA COMMISSION Article 56 The Media Commission will be responsible mainly to maintain permanent contact with all media and establish the interests of the public relations and communications. It will maintain a permanent relationship with the Department of Communications of FIBA Americas. It will determine the technical operative clauses necessary for better attention to the media during all activities of FIBA Americas, specially the ones related with the Tournaments, making sure that they all the media in our continent. FIFTH SECTION ORGANIZATIONS OFFICIALLY RECOGNIZED BY FIBA AMERICA I. General Provisions Article 57 With the objective to promote Basketball in our continent, FIBA Americas can recognize certain organizations. The Directive Board can decide the recognition of these organizations. The organizations must have the possibility of conducting themselves freely to achieve their goals, subject to the corresponding approvals of the National Federations, Zone Commissions or the Central Board of FIBA Americas. These organizations do not have a right to represent FIBA Americas in any way. II. BASKETBALL COACHES ASSOCIATION OF AMERICA Article 58 The Basketball Coaches Association of America is the organization which represents the Coaches of America that belong to Coaches Associations recognized by members of the National Federations. The Statutes and Regulations of the Basketball Coaches Association of America and of the National Basketball Coaches Association, if it existed, must consider the spirit and that provided by the Statutes and Regulations of the corresponding National Federations, FIBA Americas and FIBA and must be approved by the Central Board of FIBA Americas, (See Article 50, 51 and 52 of the FIBA Statutes). The General Assembly of the Basketball Coaches Association of America will elect the President and the members of its Central Board, one of which must be the Secretary General of FIBA Americas or his/her representative. The headquarters of FIBA Americas will be the home of the Basketball Coaches Association of America and the Secretary General of FIBA Americas will be responsible to manage its matters. CHAPTER THREE GENERAL DISPOSITIONS Article 59 The income of FIBA Americas are: h) The annual estimates of the members of National Federations. i) The payments from members of National Federations who organize Tournaments according to the Financial Dispositions of the Regulations of said Tournaments. j) The payments of licenses and transfers of players. k) The payments of registration of participation of all activities organized by FIBA Americas. l) The rights and fines according to the corresponding regulations. m) The percentage of rights of television set by the Central Board. n) Donations, subventions and several incomes. Article 60 The Annual Financial Exercise starts January 1st and ends December 31st and the payment for annual estimates must be made within the first three (3) months of each Financial Exercise. Article 61 If a National Federation doesn’t pay its annual estimate during three (3) years to FIBA Americas or its Zone, this Federation will be made, after being approved by the Central Board, ASSOCIATED MEMBER of FIBA Americas and its Zone. A National Federation that is made ASSOCIATED MEMBER loses its right to vote in the Congresses of and FIBA Americas and its Zone, and its teams cannot participate in any official competition. FIBA Americas should inform to FIBA upon any National Federation that have passed to the condition of ASSOCIATED MEMBER in the Continent. Article 62 No quorum is required to the Congress, Central Board, Executive Committee or of the Permanent and Special Commissions of FIBA Americas to be legally valid. The voted decisions are considered by simple majority of present votes, directly or secretly. The elections of the authorities will be through secret scrutiny and whoever gets more votes is elected. Article 63 The colors, flags, insignias and logos of FIBA Americas, will be approved by the Central Board. Article 64 Any controversy that is begun by the General Statutes and Internal Regulations of FIBA, FIBA Americas or of the Zones, and which cannot be reconciled, must be decided definitely by a COURT, according to the Statutes and Regulations of the Arbitration Court for Sports, Lausanne, Switzerland. The parts implicated must commit to abide by the Statutes and Regulations of this Sports Court and accept and comply in good faith, with its decision. The National Federations affiliated to FIBA must make sure that, in their own country, the General Statutes and Internal Regulations of FIBA, including the clause that states the Court Arbitration by the Arbitration Court of Sports, must be considered in the Regulations of the National Federation, Regional Federation, if it existed, clubs, players, directives and officials. Article 65 The official languages of FIBA Americas are Spanish and English. In case of controversy of the interpretation of the General Statutes and Internal Regulations of FIBA Americas, the text in Spanish will be considered true.
